These Terms and Conditions govern your use of netherlandsunlocked.com and, unless a separate written agreement applies, consultations and other services that you book or purchase directly through the Website. Netherlands Unlocked is a business registered in the Netherlands and based in Amsterdam. Our current business registration and contact details are shown in the Website footer and on the Contact page.

These Terms do not replace a signed service agreement, proposal, brokerage agreement, referral agreement, statement of work, or other written agreement that applies to a specific service. If a separate written agreement conflicts with these Terms, that separate agreement controls for that service. Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded.

1. About Netherlands Unlocked and the scope of these Terms

Netherlands Unlocked provides relocation planning, practical coordination, business and website support, general information, consultations, and related services for people moving to, living in, or leaving the Netherlands.

These Terms apply to the Website and to services booked or purchased directly through the Website when no separate written agreement applies. Larger or more detailed engagements may be governed by a separate written scope or service agreement.

2. Who may use the Website and book services

You must have legal capacity to enter into an agreement. If you book or purchase a service for another person, a company, or another organisation, you confirm that you have authority to do so and to provide the information needed for that service.

3. Use of the Website

You may use the Website only for lawful purposes and in a way that does not interfere with the Website, its security, or the rights of other people.

You must not attempt to gain unauthorised access to the Website or connected systems, deliberately introduce malicious code, submit false or fraudulent information, or use automated systems to collect Website content without our prior written permission where permission is legally required.

4. General information and professional boundaries

Website content, articles, checklists, service descriptions, and general guidance are provided for general informational purposes. They may not reflect your specific circumstances or the most current law, policy, market practice, or administrative procedure.

Netherlands Unlocked does not provide legal, immigration, tax, accounting, mortgage, insurance, notarial, investment, or other regulated professional advice unless a service is expressly provided by an appropriately qualified professional under a separate professional relationship. Where specialist advice is needed, you should rely on the relevant qualified professional.

5. Online bookings and contract formation

Before you submit a paid booking, the Website will show the main features of the service, the price, applicable taxes, payment information, and any booking specific conditions. You will have an opportunity to review and correct the information you enter before submitting the booking.

Where payment is required at booking, your order creates a payment obligation only when you use the final payment control that clearly indicates payment is required. A contract for the booked service is formed when Netherlands Unlocked sends you confirmation that the booking has been accepted.

After the contract is formed, we will provide confirmation by email or another durable form. The confirmation will contain or provide the required contract information, including the service purchased, price, relevant cancellation information, and the Terms that applied to the transaction.

If we cannot accept a booking after payment has been taken, we will notify you and refund the amount paid for the service that cannot be provided.

6. Prices, VAT, and payment

Prices shown to consumers on the Website include VAT where VAT applies, unless the Website clearly states otherwise in a situation where a different presentation is legally permitted. Any additional charge that applies to a booking will be shown before you place the order.

Payment is due at the time and in the manner shown during the booking process. For services arranged through a separate proposal, invoice, or service agreement, the payment terms in that document apply.

Payment processing may be provided by an external payment provider. The provider may process payment information under its own terms and privacy information.

7. Providing the service and your responsibilities

Netherlands Unlocked will provide agreed services with reasonable care and skill and within the scope described at booking or in the applicable written agreement.

You are responsible for providing accurate and reasonably complete information, responding to requests that are necessary to perform the service, and attending scheduled appointments. You remain responsible for decisions you make and for obtaining specialist advice where your situation requires legal, immigration, tax, financial, mortgage, notarial, insurance, or other regulated advice.

Government authorities, landlords, lenders, real estate parties, service providers, and other third parties make their own decisions. Netherlands Unlocked cannot guarantee an approval, transaction, housing result, immigration result, financing result, search ranking, business result, or other outcome controlled by another person or organisation.

8. Appointment changes and voluntary cancellations

The cancellation and rescheduling rules in this section apply to scheduled consultations unless a booking page or separate written agreement states otherwise. These voluntary rules are separate from the statutory consumer right of withdrawal described in section 10. Nothing in this section removes or reduces a statutory right that applies to you.

8.1 Cancellation and rescheduling of paid consultations

Paid consultations may be cancelled or rescheduled without charge if Netherlands Unlocked receives notice at least 24 hours before the scheduled start time.

If you cancel at least 24 hours before the scheduled start time, any amount paid for that consultation will be refunded in full. If you reschedule at least 24 hours before the scheduled start time, your payment will be transferred to the new appointment.

The 24 hour notice period is calculated from the scheduled start time shown in your booking confirmation.

8.2 Cancellation within 24 hours

If you cancel a paid consultation less than 24 hours before the scheduled start time, Netherlands Unlocked may retain up to 50 percent of the consultation fee as a reasonable cancellation charge.

Any cancellation charge will not exceed the reasonable costs and losses resulting from the cancellation, including preparation already completed, time reserved for the appointment, and the loss of a reasonable opportunity to offer that appointment to another client.

Where the reasonable costs or losses are lower than 50 percent of the consultation fee, the cancellation charge will be reduced accordingly.

8.3 Late rescheduling

If you request to reschedule less than 24 hours before a paid consultation, Netherlands Unlocked may, at its discretion, allow the consultation to be moved to another available date without an additional charge.

Where a late reschedule is approved, the payment already made will be transferred to the new appointment. A discretionary late reschedule is not guaranteed and may normally be offered only once for the same consultation.

If a late reschedule is not approved, the request will be treated as a cancellation within 24 hours and the applicable cancellation terms will apply.

8.4 No shows

If you do not attend a scheduled paid consultation and do not provide notice before the appointment, Netherlands Unlocked may retain up to the full consultation fee.

Any amount retained will be limited to what is reasonable in light of the time reserved, preparation already completed, inability to offer the appointment to another client, and other reasonable costs or losses caused by the missed appointment.

If circumstances justify a lower charge, Netherlands Unlocked may refund part of the consultation fee.

8.5 Cancellation by Netherlands Unlocked

If Netherlands Unlocked needs to cancel a paid consultation, you may choose either to reschedule the consultation to another available date without additional charge or to receive a full refund of the amount paid for that consultation.

Netherlands Unlocked will make reasonable efforts to provide as much notice as possible. Nothing in this section limits any additional rights you may have under applicable law where a service is not provided as agreed.

8.6 Exceptional circumstances

Netherlands Unlocked may waive or reduce a cancellation charge where it considers this reasonable because of illness, emergency, serious travel disruption, or other exceptional circumstances.

Any decision to waive or reduce a charge is made on a case by case basis and does not create an obligation to do so in another situation.

8.7 Free Introductory Calls

There is no cancellation charge for a free Introductory Call.

If you cannot attend, please cancel or reschedule as early as possible so that the appointment can be made available to someone else. If you repeatedly miss free appointments without notice, Netherlands Unlocked may restrict further automatic booking and require you to contact us before another appointment is scheduled.

8.8 How to cancel or reschedule

You may cancel or reschedule an appointment using the cancellation or rescheduling link provided in your booking confirmation, where available. You may also contact Netherlands Unlocked using the contact details provided with your booking.

A cancellation or rescheduling request is effective when it is received by Netherlands Unlocked.

Where a statutory online withdrawal function is available on the Website, that function is intended for exercising the statutory right of withdrawal and is separate from ordinary appointment rescheduling.

8.9 Refunds under the voluntary cancellation policy

Where a refund is due under this voluntary cancellation policy, Netherlands Unlocked will return the amount due using the original payment method unless another method is agreed.

Refund processing may depend on the payment provider used for the original transaction. Where the cancellation also falls within a statutory right of withdrawal, the legally required refund period and other statutory rules will apply.

9. Cancellation of projects and service packages

The 24 hour appointment cancellation policy applies to individual scheduled consultations and does not determine the amount payable when a larger project, service package, or ongoing assignment is cancelled.

If you cancel a project or service package after work has begun, Netherlands Unlocked may charge for work properly completed up to the date of cancellation and for reasonable costs or losses that cannot be avoided.

In determining any amount payable, Netherlands Unlocked will take account of costs that are no longer incurred because of the cancellation and any reasonable opportunity to use the reserved time or resources for other work.

Any prepaid amount that exceeds the amount reasonably due for completed work and unavoidable costs will be refunded. Where a separate written service agreement applies, the cancellation terms in that agreement will apply to the extent permitted by law.

10. Statutory right of withdrawal for consumers

This section applies when you are a consumer and you enter into a qualifying service contract with Netherlands Unlocked at a distance, including through the Website. A consumer is a natural person acting mainly for purposes outside that person’s trade, business, craft, or profession.

You generally have 14 days from the conclusion of the service contract to withdraw without giving a reason. Where the statutory right applies, you may exercise it through the online withdrawal function provided on the Website, by using the model withdrawal form, or by sending any other clear statement that you wish to withdraw.

If you withdraw within the statutory period, Netherlands Unlocked will refund payments that must legally be refunded within 14 days after being informed of the withdrawal. The refund will normally use the same payment method used for the original transaction unless another method is expressly agreed and does not cause you additional cost.

If you expressly request that a paid service begin during the 14 day withdrawal period and then withdraw before the service has been fully performed, you may be required to pay a proportionate amount for the part of the service already provided, where permitted by law.

If you expressly request that the service begin during the withdrawal period and acknowledge in advance that your withdrawal right will end once the service has been fully performed, the statutory withdrawal right ends when the service has been fully performed.

If an exception to the statutory withdrawal right applies to a specific service, you will be informed before the contract is concluded. Nothing in this section restricts rights that cannot legally be excluded.

11. Complaints

If you have a complaint about a Netherlands Unlocked service, contact info@netherlandsunlocked.com and include enough information for us to identify the service and understand the issue. We will acknowledge the complaint and seek to provide a substantive response within a reasonable period.

If Netherlands Unlocked becomes legally required or contractually committed to use a specific alternative dispute resolution body, the applicable information will be provided as required by law. The former European Commission Online Dispute Resolution platform is no longer in operation.

12. Real estate services

Real estate agency services in the Netherlands are provided through the applicable eXp Nederland brokerage relationship and are governed by the brokerage terms, agency agreement, purchase agreement, sale agreement, or other documents that apply to that transaction.

Where a property need involves another country or market, Netherlands Unlocked may introduce you to an appropriate real estate professional or brokerage. Any representation, fees, duties, and legal obligations connected with that professional are governed by the separate relationship between you and that professional or brokerage.

13. Professional introductions and third party services

Netherlands Unlocked may introduce you to accountants, tax advisers, immigration professionals, mortgage advisers, notaries, insurers, movers, real estate professionals, or other service providers. An introduction does not make the third party an employee or agent of Netherlands Unlocked and does not guarantee the quality, availability, advice, price, or outcome of the third party service.

If you decide to engage a third party, that engagement is a separate agreement between you and the third party. You should review that provider’s terms, privacy information, fees, and professional qualifications before engaging them.

14. Intellectual property

Unless a separate written agreement states otherwise, Website text, graphics, logos, images, downloads, branding, and other Website content are owned by or licensed to Netherlands Unlocked and are protected by applicable intellectual property law.

You may view, download, or print Website content for your own personal and non commercial use. You may not reproduce, republish, sell, distribute, or commercially exploit Website content without prior written permission unless applicable law permits that use.

Ownership and permitted use of deliverables created for a client are governed by the applicable proposal, service agreement, or written scope where one exists.

15. Privacy and cookies

Personal data is processed as described in our Privacy Statement. Our Cookie Policy explains the cookies and similar technologies used on the Website and how you can manage applicable choices.

These Terms do not replace the Privacy Statement or Cookie Policy. Where personal data is shared with a professional or service provider at your request or as necessary to provide a service, the processing is handled as described in the Privacy Statement and applicable law.

16. Third party websites and tools

The Website may link to external websites, government resources, booking tools, payment services, maps, social networks, and other third party services. Netherlands Unlocked does not control those external services and is not responsible for their content, availability, security, or privacy practices.

A link or introduction does not by itself mean that Netherlands Unlocked endorses every statement, product, or service offered by that third party.

17. Liability

Netherlands Unlocked is responsible for its obligations to the extent required by applicable law. To the extent permitted by law, Netherlands Unlocked is not responsible for loss caused solely by decisions or actions of government authorities, landlords, lenders, search engines, platforms, real estate counterparties, or other independent third parties outside our reasonable control.

Nothing in these Terms excludes or limits liability where an exclusion or limitation is prohibited by mandatory law. Nothing in these Terms removes any mandatory consumer remedy.

Where a separate signed service agreement or brokerage agreement contains liability provisions for a specific service, those provisions apply to that service to the extent permitted by law.

18. Website availability and events outside reasonable control

We aim to keep the Website and booking systems available, but continuous or error free access cannot be guaranteed. Maintenance, security work, internet failures, payment provider outages, booking provider outages, or other events outside our reasonable control may temporarily affect access.

If an event outside our reasonable control prevents us from providing a booked service, we will contact you as soon as reasonably possible and will offer a reasonable alternative, rescheduling, or a refund for any undelivered service where required by the agreement or applicable law.

19. Changes to these Terms

We may update these Terms for future Website use and future bookings. The current version and update date will be published on the Website.

A change to these Terms does not automatically alter the terms of a service contract that was already concluded. An existing contract remains governed by the version accepted when that contract was formed unless a change is required by law or is otherwise validly agreed.

20. Governing law and jurisdiction

These Terms and agreements governed by them are subject to Dutch law.

If you are a consumer, the choice of Dutch law does not deprive you of mandatory consumer protections that apply to you and cannot legally be excluded. A consumer dispute may be brought before any court that has jurisdiction under applicable mandatory law.

If you are acting in the course of a business or profession and no mandatory rule requires otherwise, disputes that cannot be resolved amicably may be submitted to the competent court in Amsterdam, the Netherlands.

Nothing in these Terms excludes or restricts any consumer right that cannot legally be excluded or restricted. Where a provision in these Terms conflicts with mandatory consumer law, the mandatory consumer protection will apply.

21. Severability, no waiver, and relationship between documents

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

If Netherlands Unlocked does not immediately enforce a provision, that does not mean the provision has been waived.

For a direct online booking, the service description, booking information, booking specific conditions, confirmation, and these Terms together form the agreement unless a separate written agreement applies. If a separate written agreement applies, it takes priority for the matters it covers.
